The trial ended between the Ukrainian division of Google and the company "GOU OGLE"

image The trial, which unfolded last year between the Ukrainian division of Google and the company Gou Ogle, ended. Google tried to defend the rights to the Google.ua domain, which was owned by the company GOU OGLE, which hosted a dating site.

On February 3, 2009, the Economic Court of Kiev ordered Google SEA to stop using the registered trademark of the corporation in the domain name Google.ua.ua, and register the domain zone (Hostmaster) to remove the delegation from the disputed domain. However, the respondent did not agree with this decision and filed an appeal. In a law office representing the interests of the defendant, it was clarified that GOU OGLE companies since 2006 have owned the Google and Go Ogle trademarks registered in Ukraine for classes 9 (scientific instruments, computers, cash and counting machines) and 45 (social, security services, marriage agencies).

“Formally, GOU OGLE could register the Google trademark,” experts say. “For example, if Google has registered its trademark in class 35 (advertising services), then another company may well register the same trademark in class 45. This is not against the law. However, Google is more likely to win a lawsuit because the Google trademark is well known. ”

The Kyiv Economic Court of Appeal in case No. 12/25 on the termination of intellectual property rights infringement on a commercial name rejected the appeal “GOU OGLE”, and left the decision of the Economic Court of Kiev unchanged.

Thus, Google-Ukraine will finally be able to use the Google.ua domain instead of the current one - Google.com.ua.

Interestingly, several more domain names were registered in the name of Oleg Bogatov, affecting the interests of large companies. In particular, Forbes.ua, Interfax.ua, Fortune.ua, Naftogaz.ua, Stirol.ua and Mittal-Steel.ua.

Let me remind you that as recently as February of this year, Google corporation sued the Belarusian domain Google.by, which was registered by a third party that has no relation to Google, and completely copied the search engine site. In this regard, the corporation appealed to the court with a claim on violation of the rights to the trademark and company name. The case was dealt with in the Supreme Court of the Republic of Belarus. The court decided to cancel the registration of this domain, with the result that Google was able to register the domain Google.by in its name.
