Video under arrest

The Moscow Arbitration Court on the lawsuit "System Mass Media" (SMM) has prohibited the owners of the site video.ru to manage the domain. Such an interim measure is first used in anti-piracy proceedings.

The Moscow Arbitration Court took provisional measures on the claim of the “World Russian Studios” (“subsidiary” of the “System of Mass Media”) to “Video.ru” on April 6, and the term of its appeal expired on May 5 (copy of the court decision is at the disposal of “Vedomosti” ). In the lawsuit filed on February 12, the SMM demands 24 million rubles from Video.ru. in her opinion, for the unauthorized posting on video.ru of the 12 episodes of the television movie “Brothers of Detectives” (the rights to it belong to the “World Russian Studios”). The amount of required compensation, according to the vice-president of the SMM Evgeny Savostyanov, is a record for the Russian anti-piracy case.

The court forbade Video.ru to terminate the administration of video.ru ahead of time, transfer it to third parties, and also change the domain registrar. The registrar "Russian Network Information Center" is prohibited from re-registering video.ru. Until the end of the trial, the defendant can sell or close the offending site to disown responsibility for the content posted on it, explains the need for Savostyanov measures. And the cost of the domain can be taken into account with possible damages, he adds.

The complaint against the court’s decision has already been filed, said Fyodor Boykov, deputy general director of Video.ru. The interim measures are “totally inadequate” and not relevant to the current case, he stresses.

According to Liveinternet, video.ru is visited daily by 45,000-50,000 users. Representatives of Video.ru are positioning the online store as the largest seller of legal video in runet. “Brothers detectives” appeared on video.ru at the end of 2009. According to Boikov, access to the films that caused criticism from the SMM was closed in early February - after receiving claims from the copyright holder.

Oleg Yashin, vice-president of the Russian Shield anti-piracy association, could not recall cases where a Russian court would impose sanctions on the domain name of the site suspected of piracy. But there will be no consequences for Video.ru: the site is instructed not to change the domain name, but not to curtail its activities, he notes.

The plaintiff at the same time claims for very large compensation and seeks not to close, but to preserve the domain in working condition. This has not happened in Russian practice yet, says the general director of Starblaser Alexander Klintsov. In his opinion, the further work of video.ru will require exceptional attention to the legality of the content. The legal video content market is in its infancy and different structures often have different types of rights to the same film, Klintsov says.
