Comments by the representatives of the Russian Space Systems OJSC on the situation with the Makhost company. Extending temporary access to resources via FTP / SFTP / SSH
The official comment of the representatives of the Russian Space Systems OJSC:
In July 2009, the MSHost.ru Limited Liability Company, represented by the General Director of Sverschevsky Anton Gennadievich, concluded an agreement for the provision of services for the placement of server (client) equipment at the technological site (in the data center) of FGUP RNII KP "Russian space systems"). The agreement with MskHost.ru was concluded on behalf of the agent - Limited Liability Company Merkurius (now Oversan-Mercury LLC).

Starting from July 2009 until the end of 2009, the service was rendered in full, the fact of rendering services from July to December inclusively was confirmed by bilateral acts between Oversan-Mercury LLC and MSHost.ru LLC. For the specified periods, LLC “Oversan-Mercury” in the prescribed order put forward the requirements (invoices) for payment of work performed (services rendered).
So far, LLC Mskhost.ru has not paid for services for 5 months (from August to December, inclusive). A letter requesting payment and indicating the amount of the debt was sent by Oversan-Mercury LLC to Mskhost.ru LLC on February 17, 2010. There was no payment, response or proposals for negotiating the maturity of the debt from LLC Mskhost.ru not received, in connection with which, guided by Articles 382 and 993 of the Civil Code of the Russian Federation between JSC Russian Space Systems and LLC Oversan-Mercury »On March 26, 2010, a contract of assignment of rights (claims) was concluded, in accordance with which Oversan-Mercury LLC transfers its rights to collect debts in favor of OJSC Russian Space Systems, while providing the necessary assistance in this matter.
04/06/2010 Russian Space Systems OJSC sent a claim to MSHOST.ru LLC, in which it demanded to repay the arrears and pay the penalty. In addition, in accordance with Art. 396 of the Civil Code of the Russian Federation, the equipment of the LLC Mskhost.ru company is held until the debtor fulfills its obligations. In order to avoid possible delay in solving the problem with the debt that was formed by Mskhost.ru LLC, guided by clause 2.1.9 of the contract for the provision of services for the placement of server (client) equipment, according to which “In the event that the payment of services was not made by the Customer in during one billing period, the Contractor reserves the right to suspend the provision of services without prior notice ... ”the provision of services is suspended until the full repayment of the arising debt.
Taking into account the current difficult situation for the clients of the company “Mskhost.ru”, in order to minimize the consequences for third parties, access to the information resources located in the LLC “Mskhost.ru” is open via ftp, sftp, ssh until 19:00 07.04.2010.
