FAS filed a case against Microsoft

The Federal Antimonopoly Service (FAS) of the Russian Federation on Thursday filed a case against Microsoft in connection with the reduction of supplies to the Russian Federation of the Windows XP operating system!



The corresponding notice is posted on the website of the antimonopoly authority of the Russian Federation.

"The signs of violation of antitrust laws by Microsoft are seen in the economically or technologically unjustified cessation of the production and supply to the Russian Federation of operating systems (OS) for personal computers (PCs) of the Microsoft Windows family of boxed versions - Windows OS distributions and reducing the supply of this OS as pre-installed when selling a new computer, as well as setting different prices for the Windows XP operating system.

In order to implement measures to prevent and suppress violations of the antimonopoly legislation of the Russian Federation in the field of information technologies, the FAS Russia considered the situation in the software market.



As a result of market analysis of proprietary (non-free software products, where the copyright holder retains a monopoly on their use, copying and modification, and the source code of these software products is protected by copyright) PC operating systems have established a dominant position of Microsoft in the market under investigation.



As the sole owner of the “boxed” and OEM versions of the OS “Windows XP”, Microsoft in an official letter confirmed the decision to discontinue retail sales of this product from June 30, 2008.



The results of the analysis of the dynamics of the presence of various operating systems show that the transition to the new Windows Vista OS occurs with continued demand for the previous Windows XP operating system.



The presence of demand for boxed and pre-installed versions of Windows XP is also confirmed by retailers and the number of orders in public procurement. ”
