The group "Bi-2" took advantage of the right to prohibit the distribution of their songs on the Internet and, through the courts, obtained their removal from the catalog of FA FAIR , the society for the collective management of copyright. Last, we recall, operates on the basis of Article 45 of the Law of the Russian Federation "On Copyright and Related Rights", engaged in issuing licenses for the sale of music, as well as collecting deductions from sellers in favor of copyright holders. The company "Style Records" , representing in court the interests of "Bi-2", also sought to exclude songs from other artists from the FAIR catalog, but unsuccessfully - failed to prove the right to act on their behalf.

"Style Records" is the first company from a number of members of the National Federation of the Producers of Phonograms ( NFPA ), which managed to defend the exclusive right to use their own works. According to its executive director, Sergey Bobzy, practically all members of the NFPA are preparing lawsuits similar to those submitted by his company. The source noted that “Style Records” had previously required the removal of Bi-2 recordings from the FAIR catalog, but the result was only a complication of the procedure for deleting songs. “Therefore, many rightholders do not even try to apply to FAIR,” Bobza explained.

The position of the NFPF regarding the activities of the FAIR was formulated by the director of the federation Alexey Ugrinovich: “From our point of view, all the activities of societies for collective management of rights do not comply with the law. The basis of legal business is direct contracts between users and rightholders ”.

Russian justice, we note, has already recognized the illegal online trade in music, “backed up” only by the FAIR license. So, last month the court found copyright holders of mp3-site owners delit.net and delit.ru (plaintiff - Gala Records) to be infringing copyright.
