Willy Tokarev filed a lawsuit in the Presnensky Court of Moscow,
reports Gazeta . For violation of his copyright and related rights, he demands from the music site
Zvuki.Ru the amount of 200 thousand rubles. The reason is allegedly illegal placement on the site of several songs by the author.
The defendant in the lawsuit is the owner of the site Zvuki.Ru and the well-known
fighter against musical piracy in Runet and the winner of the industry
Runet awards Sonya Sokolova. More recently, Sonya Sokolova with Willy Tokarev
spoke at a briefing on the legal music trade on the Internet.
Sonya Sokolova claims that the rights of the artist were not violated and the site a few years ago received a license to use the works of Tokarev. True, it was not a direct contract with the author, but a license of a record company, which gave the right to conduct an introductory broadcast in real audio format.

The lawsuit of Willi Tokarev deals with eight songs, including “I lose”, “Goodbye, New York”, “You are a man”. Note that all these songs are included in the
album "Goodbye, New York" , which was posted on the site Zvuki.Ru. This album also includes songs "ZEC", "Malina", "Gang" and other thieves hits. Now they can not be downloaded from the site, whereas earlier, for several years, they lay in the public domain and you could listen to the songs absolutely free.

According to the lawyer, no contract with the copyright holder was concluded. Therefore, Willy Tokarev asks to recover 160 thousand rubles for violation of copyright and related rights and another 40 thousand rubles for moral damages. In the future, the 72-year-old singer intends to file new claims against other online stores that illegally post his musical works. Claims against “three major music portals” will be filed soon, the lawyer says.
In turn, Sonya Sokolova told the Gazeta correspondent that she had “not seen any lawsuits and had not received any subpoenas”, but she considers the claims addressed to her to be groundless. “Some time ago, we actually placed Willy Tokarev's songs on the site from Farewell, New York,” she said. - However, we operated under a license that we received from the record company Moroz Records back in 2000. I will gladly demonstrate it in court. ” As Sokolova noted, this license provided for the use of works only in real audio format, for a one-time familiarization audition, and “there wasn’t even a download”.
