"New focus" do not confiscate

The site “New Focus” will not be confiscated, but it will be able to continue work only after registration as a media outlet. This decision was made today by the Abakan City Court, reports Regnum . Advocates of the online edition are going to appeal it.



Recall, on December 1, 2006 in Abakan, Magistrate Marina Khokhlova decided to confiscate the “New Focus”, since its owner, journalist Mikhail Afanasyev, did not register the site as media. The amount of the fine assigned for payment to the owner was 20 thousand rubles. In response, Afanasyev appealed to the lawyers of the Interregional Human Rights Association “AGORA” and appealed against this decision.



The decision of Judge Svetlana Shapovalova, in fact, excludes from the previous one only the item on the confiscation of the site. Explaining this fact, the judge noted that the online publication “New Focus” meets all the characteristics of the media and is it.

At the same time, in the course of the case, the Central-Siberian Department of Rosokhrankultura submitted to the court a document indicating that the principle of voluntary registration of the media currently operates on the Internet. But the judge, having studied him, came only to the conclusion that the site owner had not applied for registration.



Attorney Afanasyev Irina Khrunova noted in her comment to the court decision that the owners of “inconvenient” sites in Russia can breathe a sigh of relief. She added that the illegal decision on the mandatory registration of the "New Region" remains in force only for the time being: "We will appeal against it to the Supreme Court of Khakassia."



The case against the chief editor of the site Mikhail Afanasyev and journalist Andrei Sakharov began on November 14 last year. He was initiated by the prosecutor's office of Abakan on the fact of an administrative offense - distribution of media products without registration.
