Alltunes.com was left without Visa and MasterCard

The online music store Alltunes.com repeats the fate of its long-suffering "brother" in the business Allofmp3.com - it was also disconnected from the Visa and MasterCard (MS) payment systems. The store owners do not grumble and have already filed a lawsuit against Rosbank and its subsidiary United Card Services to the Moscow Arbitration Court - these structures were directly involved in disconnecting sites from payment systems. According to Vedomosti , the plaintiff considers it illegal to disconnect Alltunes.com from Visa and MC, since payment systems can only disconnect customers who do not comply with the laws of their countries. The owners of Alltunes.com from the Internet-Audit company claim that they work exclusively within the framework of the law, and through the court they demand from Rosbank to fulfill the conditions of the contract.



This conflict seems to be indicative of the confrontation of Western rightholders and Russian sellers of mp3-music. The parties are holding their positions with all their might - the first claim that Allofmp3.com and the company are grossly violating all sorts of laws, the second - that, according to Russian norms, they are definitely fine. And no one has yet judged them objectively.



For example, now representatives of Visa, explaining the disconnection of Alltunes.com, say that the decision of their company fully complies with the laws of Russia, as well as international copyright and intellectual property standards. At the same time, the owners of Alltunes.com state in their lawsuit: “Visa is entitled to terminate the contract with the client only if he violates the terms of the contract or the rules of the Visa payment system. But in the case of Alltunes.com, none of the stipulated grounds for termination of the contract does not take place. ” Their indignation can be understood - for the music on the site Alltunes.com using Visa and MC cards paid off in 95-99% of cases.

The large American law firm representing Allofmp3.com recognized the illegality of blocking remittances to Russian stores mp3. In September, she sent a letter to Visa confirming the illegality of disconnecting the Russian site from payment services. In addition, lawyers saw a violation by Visa of its own rules.



On the other hand, the head of the Russian representative office of IFPI (International Phonogram Manufacturers Association) Igor Pozhitkov fully supports the decision of Visa and MC. He recalls that the “cover-up” scheme is licensed by societies for the collective management of “swindling” rights, and in fact it is the majority of the Russian online music business that relies on it. “We want the court to put an end to the question of whether the activities of sites selling music via the Internet are legal,” UCS CEO Vladimir Komlev said.
