Anti-pirates get to the "physicists"

Individuals will be fined for posting and downloading counterfeit in networks and on hosting (even if they did not know that they post and download pirated copies).

Lenta.Ru writes that in the near future, users of pirated computer programs, as well as owners of home networks and video hosting sites, will begin to be fined for violating intellectual property rights, even if they did not know that they are using counterfeit.

On January 1, 2008, Article 1250 of the Civil Code of the Russian Federation (“Protection of Intellectual Property Rights”) entered into force. This article states: “The absence of guilt of the violator does not exempt him from the obligation to stop the violation of intellectual rights, and also does not preclude the use of measures against the violator aimed at protecting such rights.

')

Previously, “measures” were applied only to “innocent” legal entities - counterfeit users, but now this practice will be extended to ordinary citizens. The Supreme and Arbitration Courts clarified that a person who used counterfeit unconsciously can only reduce the amount of the fine (in the case of a deliberate violation, it ranges from 10 thousand to five million rubles), but not exempt from it at all. That is, the user can now be fined, even if he proves that he did not know about the illegality of the program installed on his home computer.
