Vedomosti also lost

The confrontation between Vedomosti and RBC gained regular court results: the claim of Business News Media to RosBusinessConsulting was rejected yesterday by the Moscow Arbitration Court, Kommersant reports.

The requirement to collect RR 257 million for illegal reprinting of the newspaper’s materials remained unsatisfied, since the plaintiff did not provide sufficient documents confirming his copyright powers. Judge Elena Shlykova promised to make a motivating part of this decision within two weeks.

In an interview with the newspaper Utro.Ru, lawyer Vadim Uskov, representing the interests of the Internet holding, said: “It seems to me that the judge understood that the object of the lawsuit was not copyright infringement, but the desire of the plaintiff to defame RBC’s name and reputation.” In his opinion, guided by these very motives, Business News Media sent a lawsuit not to the company owning the website Quote.Ru , but to a public holding whose shares are placed on the stock market.

In a commentary to the Kommersan newspaper, Vadim Uskov explained that the case was also won due to the procedural errors of Vedomosti. He said that the plaintiff’s representatives had submitted to the court only labor contracts with the authors of the articles, whereas under the law “On Copyright and Related Rights” this was not enough. “They should have submitted copyright agreements,” said the lawyer.

Yuri Rovno court decision seems logical. “The court simply accepted our arguments,” he said. This decision was not a surprise for Vedomosti, judging by the words of Elena Bystrova, PR director of Business News Media. "This case generally went that way, we were caught on any clue," she said, "there are many loopholes in our legislation."

At the same time, “Vedomosti” promise not to surrender and file an appeal. “We assured every controversial article from a notary,” said the PR director. “We don’t fuss and we believe that the matter will be decided in our favor.”

Recall RBC's claim to Vedomosti, containing a claim of compensation in the amount of 286 million rubles, was also rejected a few days ago. It contained a protest against copyright infringement by the Vedomosti newspaper, which, according to RBC, illegally reproduced, distributed and processed articles borrowed from the agency’s paid information and analytical tape from 2002 to 2005.
