Apple have been litigating for quite some time. Qualcomm believes that the manufacturer of the iPhone illegally uses patented technology and does not pay royalties. Earlier, Qualcomm filed lawsuits in the courts of the United States and China. In the first case, the company asked to ban shipments of the iPhone to America, and in the second - to stop the production of smartphones.

This week in the USA an interim verdict was
passed on one of the cases. Judge Mary McNamara felt that Apple really violated two Qualcomm patents and recommended banning the importation of certain iPhone models into the country.
What is the essence of the dispute
According to Qualcomm, Apple without permission used the patented technology to develop the Force Touch function and the power supply system for the iPhone. Whole company from Cupertino was accused of violating six patents.
The claims concerned a number of smartphones, including the iPhone 6S, iPhone 6S Plus, iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X.
According to Qualcomm management, Apple owes the company billions of dollars in licensing fees for using proprietary technologies.
What happened this week
The United States International Trade Commission (ITC) dealt with two cases in parallel. According to one of them, the Qualcomm lawsuit was rejected; in the second case, the judge agreed with the arguments on the infringement of two patents and recommended imposing a ban on the import of some iPhone models.
This does not mean the final victory of one of the parties. So far, the ban is recommended only by one judge, the final decision of the Commission will be published in July 2019.
In addition, the United States Patent and Trademark Office conducts its own proceedings. Consideration of the issue by this agency will take about another year.
In April, another trial will take place in the San Diego City Court. It will be dealt with by Apple’s complaint that Qualcomm has violated its obligations to ensure fair pricing for licensing proprietary technologies that are market standards.
Perspectives
According to analysts, even if in the end the American authorities banned the import of certain models of smartphones, this will not affect Apple’s business. In favor of the company plays the fact that the possible violations relate only to outdated models of iPhone, and in the case of a ban on the importation into the United States, the company simply stops their production.
