Kiev magazine "Mabila" lost its name in court, because the word "Mabila" is already a registered trademark. It belongs to the owner of the site mabila.ua , according to Itnews.com.ua .

The trial of the case began in October 2005. According to the court’s decision, the Factor Media publishing house will no longer be able to use the word “mabila” on the cover, pages of the magazine and in advertising without the written permission of the owners of the sign.

The Mabila site was originally a non-profit project created by a group of like-minded people. Since then, it has become a full-fledged business that works with dozens of online stores and collects up to ten thousand visitors a day.

“Mabila.ua is the most popular site on mobile communications in Ukraine since 1998,” says Sergey Betsura, owner of the resource. - Naturally, we were outraged that the magazine took our name for itself without even asking for permission to do so. It began to be published in 2003 and, in our opinion, only spoiled the image of the site with its quality. ” Sergey said that attempts to resolve the matter with the world did not lead to anything, and he was forced to go to court.

“The outcome of the process, in our opinion, is fair,” the site owner said, “we see no reason for someone to publish a magazine called, in the promotion of which we have invested so much effort.”

“This is the first precedent on the Ukrainian Internet, when a strong online business defeated offline,” Itnews.com.ua said. However, the outcome of the situation seems logical and without an emphasis on online victory. “In this situation, everything is very clear,” said Andrey Vorobyev, head of the press center of RU-CENTER . - It does not matter at the same time whether the owner of the TK conducts business - online or offline. His rights have been violated, and the court rightly stood up for his defense. ”
