NetByNet demonstratively punished

On Monday, the Federal Anti-Monopoly Service (FAS) decided to support AKADO’s claim against its younger competitor in the Moscow market of cable communication - “Consul Group of Companies”, which provides services under the NetByNet trademark.

AKADO was outraged by the content of the advertising campaign, in which the Consul distributed brochures with the text “The Internet does not work KAC nado? Take NetByNet forever. Make no mistake again! They try everyone, they choose us! ”(Exactly in such a spelling).

The FAS recognized the advertisement as unfair (according to paragraph 1 of Part 2 of Article 5 of the Federal Law "On Advertising" - "Incorrect Comparison") and unreliable (according to paragraph 1 of Part 3 of Article 5 of the same law - "Information that does not correspond to reality advertised services "). According to this fact, administrative proceedings will be initiated, during which a fine in the amount of 40 to 500 thousand rubles will be imposed on the “Consul”.

The head of the AKADO press service, Dmitry Zakharov, says that this decision "shows all the participants in the telecommunications market the boundaries beyond which it is not worth going out."

NetByNet, which has not yet issued an official comment on the FAS decision, may appeal against it in court. However, only the amount of the monetary penalty is subject to appeal. Which, however, will hardly be large - even half a million will not make the weather for the company's budget, and the action of the hand of the state regulator in any case will be noticeable from everywhere.
