An analogue of ROMS in Uzbekistan will be with a whip, but without gingerbread

On July 20, an updated law “On Copyright and Related Rights” entered into force in Uzbekistan. According to the new edition, public file archives of films and music are recognized as violating the rights of authors, if their holders do not have written agreements with copyright holders. In this regard, some Internet service providers of the republic have already closed access to free collections in their networks, reports Pc.uz.

At the same time, the Uzbek authorities understand that a ban on the distribution of video and audio products is still a dead end in solving the problem of compliance with the law. Especially if we take into account that there have not been any loud conflicts between Uzbek providers and foreign rightholders. There is no urgent need for a radical solution of the issue; therefore, measures are being taken "intermediate".

In particular, the country has created an analogue of ROMS (Russian Society for Multimedia and Digital Networks, carrying out collective management of rights) - the Uzbek Republican Copyright Agency (UzRAAP). The agency has already begun work on the conclusion of contracts with Internet providers of the republic.

“This is a compromise solution,” says Alisher Khafizov, Deputy Director General of UzRAAP. “After all, according to providers, the complete closure of the file archives in Uznet will lead to a sharp increase in external traffic (mainly from Russia and the CIS countries), overload of channels, the need for their expansion and, accordingly, an increase in the cost of access services.”

“It is clear that providers of Uzbekistan are not able to independently conclude contracts with a huge number of foreign authors,” he explains. Therefore, UzRAAP was created, with the mission of collecting “proportionate rewards” from local companies for foreign authors. However, the local analogue of ROMS is not limited to these functions. According to the deputy director general of the agency, together with law enforcement agencies, it will “comprehensively check” the country's Internet providers.

Regarding the financial side of the issue, it is known that the amount of the author's remuneration will be determined on the basis of the number of pieces of music and films used in local file storages. "The films account for about 70% of the amount of copyright, and our providers undertake after August 1, in any case, not to use new movies released during the last year," Khafizov said. as in practice it is very difficult to track the number of downloaded works from different owners. " He said that deductions would have to be made monthly.
