The Ministry of Communications and Mass Media has finally completed work on new rules for connecting telecommunication networks, which
have been talked about for a
long time . For several years now, there has been a problem in the industry that Internet instant messengers and VoIP services offer users cheap long-distance communication and drive voice traffic over the Internet, thereby violating the rules for connecting to Russian telecommunications networks. Instead of the standard charge for an international call ($ 0.14 per minute), Russian operators only get paid for a local call (a little more than $ 0.01). Soon, this "chaos" will stop.

On Amendments to Certain Acts of the Government of the Russian Federation in Part of the Interaction of Telecommunication Networks " was published on the portal
regulation.gov.ru . The new edition of the list of those who can join the local, zonal and other networks
excluded data transmission operators for the purpose of transmitting voice information , that is, VoIP operators.
Until now, the activities of VoIP operators have not been described in the legislation. If the project is accepted, VoIP subscribers will not be able to call fixed and mobile phones, and vice versa.

2. The Rules for the Interconnection of Telecommunication Networks and Their Interaction, approved by the Decree of the Government of the Russian Federation of March 28, 2005 No. 161 “On Approval of the Rules for Interconnection of Telecommunication Networks and Their Interaction” (Collected legislation of the Russian Federation, 2005, No. 14, Art. 1243; 2006, No. 2, Article 195; 2007, No. 43, Article 5194; 2008, No. 8, Article 749; No. 42, Article 4832; 2013, No. 48, Article 6263; 2015, No. 16, Art. 2371, No. 33, p. 4850):
a) clause 9 shall be supplemented with sub-clause 3 to read as follows:
“3) local telephone networks within the territory of the Russian Federation in whose territory the local telephone networks are connected.”;
b) sub-clause 4 of clause 10 shall be amended as follows:
"4) data transmission networks for the provision of communication services for the transmission of data, with the exception of communication services for the transmission of data for the transmission of voice information.";
c) in paragraph 11:
Subparagraph 2 shall read as follows:
“2) data transmission networks for the provision of communication services for the transmission of data, with the exception of communication services for the transmission of data for the transmission of voice information;”;
Add with subsection 4 of the following content:
"4) long-distance and international telephone networks.";
d) the first paragraph of clause 12 shall be amended as follows:
"12. The data transmission network operator for the provision of data communication services, with the exception of data transmission services for the transmission of voice information, provides interconnection services to operators: ";
e) clause 20 shall be stated as follows:
"20. The operator of a long-distance and international telephone communication network in the provision of interconnection services must ensure the possibility of passing traffic:
1) between public communication networks of foreign countries and telephone networks of the Russian Federation;
2) between telephone communication networks operating in various constituent entities of the Russian Federation. ”;
e) Clause 21 shall read as follows:
21. The operator of the area telephony network in the provision of interconnection services must ensure the possibility of passing traffic:
(as amended by the Decree of the Government of the Russian Federation of 29.12.2005 N 828)
1) between intercity and international telephone communication networks and local telephone communication networks operating within the territory of the same subject of the Russian Federation;
“2) between zonal telephone communication networks operating within the territory of the same subject of the Russian Federation;
3) between local telephone networks operating in different municipalities within the territory of the same constituent entity of the Russian Federation, with the exception of traffic between local telephone networks operating in various municipalities within the territory of a city of federal significance;
4) between zonal telephone communication networks and data transmission networks operating within the territory of the same subject of the Russian Federation for the provision of communication services for data transmission, with the exception of communication services for data transmission for voice transmission purposes. ”;
g) in paragraph 22:
Subparagraphs 2 and 3 shall read as follows:
“2) between data transmission networks and local telephone communication networks operating within the territory of a municipality or a city of federal significance, for the purpose of providing communication services for data transmission, with the exception of communication services for data transmission for voice transmission purposes;
3) between zonal telephone communication networks operating within the territory of a constituent entity of the Russian Federation, and local telephone communication networks operating within the territory of a municipal entity, including during call transit. ”;
Add with subsection 4 of the following content:
“4) between the local telephone communication networks operating within the territory of a municipality or a city of federal significance, and long-distance and international telephone communication networks with the appropriate connection.”;
h) clause 23 is declared invalid;
i) subclause 1 of clause 26 3 shall be amended as follows:
"1) from fixed area telephone networks and local telephone networks (if connected to a mobile radiotelephone network) to a network of another mobile radiotelephone operator operating within the territory of the same subject of the Russian Federation, if the subscriber is used as the called party the number from the numbering resource allocated to one mobile radio telephone communication operator, used by another mobile radio telephone communication operator for the provision of communication services to subscribers y, which decided to maintain the subscriber number in the contract for the provision of telecommunications services with the other operator of mobile telephone communications; ";
j) add clause 26 4 to read as follows:
“26 4 . In the interaction of mobile radio telephone networks, the mobile radio telephone operator is entitled to pass
Traffic from local telephone networks (if there is a local telephone network connection to its network) to the network of another mobile radio telephone operator operating within the territory of the same subject of the Russian Federation. ”;
k) clause 5 of Appendix No. 1 to the said Rules shall be amended as follows:
"five. The interconnection service provided by the data network operator for data transmission purposes. ";

1. Services to end a call to the network of another carrier:
a) an international call termination service for a communication network of a foreign telecommunications operator (activity aimed at ensuring traffic from the point of interconnection at the international level to the connection to the user (terminal) equipment connected to the telecommunications network of the telecommunications operator located outside the territory of the Russian Federation);
b) an international call termination service for a communication network of a Russian telecom operator (activity aimed at ensuring traffic from the point of interconnection at the international level to the interconnection to the user (terminal) equipment connected to the communication network of another telecom operator located in the Russian Federation);
c) long-distance call termination service (activity aimed at ensuring traffic from the point of interconnection at the long-distance level of connection to the user (terminal) equipment connected to the communication network of another communication operator);
d) call termination service in the subject of the Russian Federation (activities aimed at ensuring traffic from the point of connection at the regional, local or subscriber level of connection to the user (terminal) equipment connected to the communication network of another operator).
2. Services call termination on the network operator:
a) International call termination service (activity aimed at ensuring traffic from the point of interconnection at the international level to the connection to the user (terminal) equipment connected to the communication network of the same communication operator located in the Russian Federation).
b). Long-distance call termination service (activity aimed at ensuring traffic from the point of connection at the long-distance level of connection to the user (terminal) equipment connected to the communication network of the same communications operator located in the Russian Federation).

3. Call transit services (operator’s activities aimed at providing traffic through its communication network between communication networks of 2 other communication operators):
a) international transit call services:
international transit service of a call not intended to be completed on the territory of the Russian Federation;
international transit call service, intended for completion on the territory of the Russian Federation;
b) intercity call transit service;
c) call transit service within the subject of the Russian Federation.
4. Call initiation services (activities aimed at ensuring traffic from the user (terminal) equipment connected to the communication network of this or another communication operator to the point of connection to the network of this communication operator when providing access to communication services provided by other communication operators) :
a) long-distance call initiation service;
b) call initiation service in the subject of the Russian Federation. ”.
3. In the order of the Government of the Russian Federation
Dated October 19, 2005 No. 627 “On state regulation of prices for interconnection services and traffic transmission services provided by operators occupying a significant position in a public communication network” (Collected Law of the Russian Federation, 2005, No. 44, Art. 4553; 2006, No. 6, Article 696; No. 25, Article 2732; 2007, No. 47, Article 5770; 2008, No. 42, Article 4832):
a) in the Rules of state regulation of prices for interconnection and traffic transmission services provided by operators occupying a significant position in the public communication network, approved by the said decree:
Clause 17, third paragraph 2, the sentence should be amended as follows:
“Payment for the established volume of traffic transmission services is carried out at a price established for the call termination service in a constituent entity of the Russian Federation”;
clause 18 shall read as follows:
"18. Limit prices for call completion services in a constituent entity of the Russian Federation, as well as call initiation in a constituent entity of the Russian Federation are not subject to differentiation. ”;
clause 19 recognize invalid;
clause 20 shall read as follows:
"20. The price limit for call transit services within the subject of the Russian Federation is not differentiable. ”;
Clause 24 shall read as follows:
“24. If the telecom operator has set prices for traffic transmission services that exceed the regulated prices for services from the List of traffic transmission services provided by the operator occupying a significant position in the public communication network, the latter in each settlement period in addition to the total amount for transmission services traffic provided to the operator, includes the amount of compensation.
The amount of compensation is calculated as the difference in prices for traffic transmission services from the List of traffic transmission services established by the parties to the interconnection agreement, multiplied by the volume of traffic transmission services provided to an operator occupying a significant position in the public communication network. ”
b) Section II of the list of interconnection services and traffic transmission services provided by operators occupying a significant position in a public telecommunications network, the prices of which are subject to state regulation, approved by this decree, shall be amended as follows:
“II. Traffic transmission services in the telephone network
Public connections
1. Services to end a call to the network of another carrier:
a) long-distance call termination service;
b) call termination service in the subject of the Russian Federation 2. Call termination services to the network of a telecom operator:
a) long-distance call termination service
b) call termination service in the subject of the Russian Federation 3. Call transit services:
a) intercity call transit service;
b) call transit service within the subject of the Russian Federation
4. Call initiation services:
a) long-distance call initiation service
b) call initiation service in the subject of the Russian Federation. ”.

In addition, the possibility of calls between VoIP subscribers will be questionable, since such operators will not be able to receive numbering.
The largest operator "Rostelecom" positively perceived the project of the Ministry of Communications,
writes "Kommersant". For example, a representative of Rostelecom, Valery Kostarev, said: “We will study the draft as presented by the editors and send our opinion, but on the whole we share the ministry’s approach. It will eliminate the imbalance in the economic conditions of work for mobile and fixed operators. ”
Other experts did not support the disconnection of VoIP from telephone networks: “A number of innovations are surprising and do not correspond to modern trends in the development of inter-operator relations. For example, a total ban on the accession of VoIP operators to the public telephone network, ”said Evgeny Vasilyev, director general of Interregional Transit Telecom (MTT, provides traffic transit services, long-distance and international communications, IP telephony, etc.). The proposed solutions in the field of tariff rules “can significantly redraw the inter-operator and end markets, giving unfounded preferences to a significant operator, and in fact lead to the monopolization of the fixed-line market”.
For Viber, Skype and other VoIP-operators, calls to mobile and fixed phones are one of the main methods of monetization. Many users are also accustomed to making VoIP calls to regular phones, which is much cheaper than Rostelecom’s standard tariffs for international voice communication.
