"Roskomsvoboda" will reach the Supreme Court if it is forbidden to talk about VPN, Tor and proxy
Lawyers of Roskomsvoboda and the Center for the Protection of Digital Rights intend to fully oppose the court decision to block the β Toolkit β section on the rublacklist.net website with a description of the technical means for restoring access to sites registered in the banned list.
Not only Roscomsvobod suffered from the arbitrariness of the Anapa city court and the Krasnodar regional court. The local prosecutor's office has achieved the prohibition of several more sites that disseminated information about anonymizers. ')
On the same basis, the Anapa court or some other district court may well block access to Geektimes, Habrahabr and other resources on the territory of Russia with a description of VPN, Tor and proxy technologies. βToday, such decisions contradict common sense and the law, since Russian legislation does not prohibit the use of technical means that open access to blocked sites,β explains Sarkis Darbinyan, head of the legal practice of Roskomsvoboda organization, head of the Center for the Protection of Digital Rights. - Now we have filed a cassation appeal. If the highest court of Krasnodar Territory is also blind to a frivolous, misinterpretation of the current law and violations of the norms of substantive and procedural law, as well as the lower courts, we will appeal to the Supreme Court of the Russian Federation for a final decision on the case within the national justice system. And then at the ECHR, in the manner prescribed for the international institution for the protection of fundamental rights guaranteed by the Convention. β
Many experts, including representatives of Roskomnadzor - the head of department Alexander Zharov and the head of the press service Vadim Ampelonsky, have repeatedly spoken about the legality of software tools like VPN, Tor and proxy.
However, the judges in Anapa did not stop it, as well as their colleagues in the Krasnodar Regional Court.
Roskomsvoboda reminds that the overwhelming majority of sites blocked in Russia (about 95% of monitoring of registries) are limited in access due to random coincidence over IP. To date, more than 1,200,000 respectable resources that do not carry any prohibited content have been blocked.
βWe are convinced that the use of VPN, plug-ins, proxies, protected browsers and other software and cryptographic tools to protect private communications is a guarantee of respect for the civil rights of Internet users and the reliability of commercial network transactions,β Roscomsvoboda reports. - They allow:
overcome barriers associated with the use of DRM and geo-restrictions to access legal content;
protect against interception and tracking of Internet traffic and communications with web services (including in the places of use of public Wi-Fi);
restore access to legal information (media, web services, sites blocked at the same time by IP-address) "
"Roskomsvoboda" organized a fundraising "for a legal confrontation with prosecutors and courts." Accepted including bitcoins.
