Roskomnadzor proposes to ban "mirrors" of sites without a court decision, as well as to fine for advices on circumventing blocking

And search engines may be required to remove links to pirated content

The group of owners together with Roskomnadzor prepared a new bill, in which new rules are prescribed regarding the blocking of sites and their “mirrors”, Gazeta.ru reports . In particular, it is proposed to ban mirrors of sites (in respect of which a decision on the "eternal" blocking was made) without a court decision. In addition, penalties are introduced for “promoting the means of circumventing the blocking of pirated resources”. Thus, the department facilitates the work of the right holders - now you do not need to sue in relation to any of the mirrors of the already blocked site, copies of resources will be banned automatically.

At the moment, the concept of a “mirror” or a copy of a site is not legally enshrined, respectively, and there is no judicial procedure for blocking clones of blocked sites. The Moscow City Court in February of this year refused to make a decision on permanently blocking Rutracker mirrors precisely on the basis of the absence of a legislative base. If the bill proposed by Roskomnadzor and the right holders is adopted, then there will not be such a problem - they will block copies of the sites already in semi-automatic mode.

“If there is a decision to permanently restrict access to an information resource, the right holder has the right to apply to the Moscow City Court to obtain a court order restricting access to the relevant site’s mirror,” the explanatory note to the document reads.

As for the site’s mirror, it’s proposed to consolidate the following wording: “A derived site on the Internet - having a similar name and display site on the Internet, created as a result of moving, fully or partially copying information from another site on the Internet, their automatic synchronization, translation of such information from one language to another language and (or) providing users with access to services and information provided on another site through a common system of packs. ravleniya.

While it is not entirely clear who will decide on the recognition of the site as a “mirror”. “Either an authorized expert, or Roskomnadzor himself will give a conclusion that this site is a“ mirror ”, that is, it fits a number of technical characteristics, which allow to say that it is not an independent resource, but only displays or copies a previously blocked site ", - commented the vice-president of the association" Russian Shield "Oleg Yashin.

Search Engines are also bound to fight with "mirrors"

Rights holders propose to oblige to fight with copies of blocked resources and search services. If they disagree or do poor work on blocking links to pirated content, search engines will be fined . Providers who in time did not restrict access to a blocked resource will also be punished.

Told how to bypass the lock? Get fine

One of the most effective methods of dealing with pirates right holders consider the punishment of those who disseminate information on the circumvention of locks. Last month, Roskomnadzor approved a document on administrative responsibility for promoting means of circumventing blocking sites (a little later, approval of this document by Roskomnadzor was denied ). It was developed by the Association for the Protection of Copyright on the Internet (AZAPI). “The introduction of administrative responsibility for the promotion of blocking bypassing means will increase the effectiveness of blocking prohibited Internet resources,” noted the head of AZAPI, Maxim Ryabyko. The proposed amount of the fine for the offender is 50 thousand rubles.

A spokesman for Roskomnadzor, Vadim Ampelonsky, also said that it is not planned to prohibit browser extensions that help bypass the blocking. “These technical, software tools have a wide range of useful applications. But advertising these tools as ways to circumvent locks should not be a legitimate action, ”he commented on the situation. At the same time, Roskomnadzor previously reported on the premature introduction of fines for posting information on bypassing resource locks.
