FAS again fined Google and refused to extend the deadline for the execution of the order issued after the complaint of "Yandex"



The Federal Antimonopoly Service (FAS) of Russia has considered the application of Google Inc. and Google Ireland Limited to extend the period of execution of the order in the case of violation of antitrust laws for a period of one to twelve months (under various points of the order), received on September 2, 2016, and decided to refuse to meet it, according to the official service portal .

By the decision of the Moscow Arbitration Court of March 15, 2016, Google refused to satisfy the requirements on the recognition of the decision and order of the FAS of September 18, 2015 as illegal.

Google has been found guilty of violating antitrust laws and, by decision of the FAS , is obliged to pay a fine of 438 million Russian rubles. In addition, for non-compliance with the FAS prescription issued earlier, another fine was imposed for a total of 1 million Russian rubles, 500 thousand each with Google Inc. and Google Ireland Limited respectively.

The conflict between FAS and Google began after a complaint from the Russian Internet giant Yandex that the company limits the possibility of promoting third-party services. When reviewing a complaint from Yandex, FAS saw signs of unfair competition from Google and abuse of a monopoly position in the market (the majority of smartphones in the world are currently running Android OS).

As a result, FAS obliged Google to allow changing the default search on Android devices running in the Russian Federation, notify users of the platform in the Russian Federation about the existence of alternative services, and also imposed a fine of 438 million Russian rubles on the company.

According to Vedomosti, a few days ago, Google reported that it was working on the implementation of the FAS regulation and the company's specialists were working on technical details.

At the end of September, the company sent out notifications to users with instructions for changing the search service.

According to RIA , the Head of FAS, Igor Artemyev, said that they are ready to "fine Google every two weeks" until the order is completely fulfilled. At the same time, Artemyev threatened with criminal cases top managers of the Russian representative office for ignoring the decisions of the Federal Antimonopoly Service.
