For anonymous WiFi will be fined? A new bill has been submitted to the government.

The Ministry of Communications and Mass Media has submitted a draft amendment to the Law on Communications and to the Code of Administrative Offenses (CAO) for consideration by the government. The bill provides for fines for those organizers of public WiFi access who do not identify its users, Vedomosti writes .



The bill was posted on the portal regulation.gov.ru in July of this year, where the public could discuss the document. In the draft amendments, in particular, it is indicated that in order to organize public WiFi access, the subscriber (legal entity in this case) and the telecom operator must conclude an agreement on user identification. Responsibility is introduced for providing Internet access without identification. So, in the case of the first violation, legal entities and individual entrepreneurs will be required to pay a fine in the amount of 100,000-200,000 rubles. In the case of a second violation, the amount of the fine rises, and ranges from 200,000 to 300,000 rubles.



The Ministry of Economic Development has criticized the bill. So, back in October, Deputy Minister of Economic Development Oleg Fomichev negatively assessed the draft document. In his opinion, the draft law indicates excessive restrictions and obligations for business. Also, the bill, if adopted, will be the reason for the appearance of unreasonable expenses of a business or budget. In addition, the official said, the new bill duplicates changes to the Rules for the provision of communication services, which were introduced by government decrees in the summer of 2014.

In addition, the Ministry of Economic Development believes that it is not for that to bring the subscriber to administrative responsibility, since the subscriber-legal entity provides communication services, but a provider. In turn, the Ministry of Communications and Mass Media believes that responsibility for those legal entities and private entrepreneurs who create public WiFi networks should be introduced.



Unfortunately, the departments could not find a compromise solution. An appropriate protocol on disagreements was signed, and now the draft law on the introduction of administrative liability for legal entities creating public WiFi networks without identification has been submitted to the government for consideration.
