"Roskomsvoboda" in court appeals the mechanism of perpetual blocking sites

Internet resources blocked "forever" in Russia, is becoming more and more. The list already has pleer.com, flibusta.net, Rutracker, Lurkmore. However, users, resource administrations, and lawyers do not give up. Recently, the public organization "Roskomsvoboda" proposed an interesting idea - an appeal in the courts of the mechanism of "perpetual blocking", writes "Kommersant". Lawyers of the organization plan to appeal not only to the Constitutional Court of the Russian Federation, but also to the European Court of Human Rights.

In order to ensure the normal work of lawyers to appeal to the courts of the site blocking mechanism, funds are needed. These funds are proposed to collect using crowdfunding. Roskomsvoboda has already launched ZaRunet.org, where anyone can "take part in the campaign to appeal against the" perpetual blockages "of Internet resources in court and raise funds for legal work in this area."

According to Sarkis Darbinyan, head of the legal practice of Roskomsvoboda, even some right holders are ready to appeal against blocking websites. “The private interests of some copyright holders representing certain tabloid writers and low-profile film owners who did not justify even in theatrical hire caused blocking the largest file sharing sites for ordinary users and the authors themselves who decided to share their works with the audience using torrent networks. And for some reason, their rights to disseminate and access to information were not taken into account, ”Darbinyan comments on the situation.

Artem Kozlyuk, the head of Roskomsvoboda, believes that during the three years of operation of the law on blocking websites, officials blocked about a million websites. "Government departments often place websites under blocking, without any legal grounds for that, and there is also an urgent need to restrict access to those Internet resources for which no decisions of the court or department took place at all, simply because their network addresses have been entered, ”says the head of the organization.
