Ukrainian court asked Facebook to provide investigators with access to the company's office to familiarize themselves with a number of documents.

Today it became known that the Pechersk court of Kiev asked the Facebook administration to give access to the investigation to the headquarters in Menlo Park and London, at the addresses: Facebook Inc. 10 Brock Street, NW1 3FG London, United Kindom 1601 Willow Road Menlo Park, CA 94025 United States. At the same time, the management of the company is asked to provide investigators with access to documents related to the case before the court.

The corresponding decision is already entered in the register . The court’s decision deals with a criminal investigation of a case under Part 2 of Art. 115 (murder committed by a group of individuals), writes ain . Investigators, to complete the investigation, need to access data from an already deleted account on the social network Facebook.

If the administration of the social network refuses to assist, the court may decide to conduct a forced search in the headquarters of Facebook, for the withdrawal of documents and things related to the case.

- to gain access to things and documents relevant to and being with third parties, you need permission from the court. The court decision lists the addresses of Facebook offices insofar as in the CPC of Ukraine, art. 163 clause 5 formally indicated exactly this form of filling in this document.
- the decision of the court itself does not directly oblige fb to give access to the seizure of servers and documents, but only allows the prosecutor's office to turn to fb for the provision of documents (and, formally, the seizure, of course, because the wording of the law also includes the seizure, and It cannot be interpreted differently), but whether it will be a request from the prosecutor’s office only to receive information from remote fb accounts, or there will be an inadequate appeal about removing servers and documents, that is another question.
