The Australian Federal Court issued an unusual
decision : according to the verdict, the company owning the copyright to the film must pay an amount of 600,000 Australian dollars ($ 442,000) if it wants to access the personal data of users who illegally downloaded the file from the Internet. The decision of the court can be found
here . The judges acknowledged that the methods with which the company is going to fight the "pirates" are not definitively disclosed, and personal information can be used to claim unreasonably large damages from users.
Dallas Buyers Club LLC from the United States owns the copyright on the film Dallas Buyers Club, in which the leading roles in which Matthew McConaughey and Jared Leto received the Golden Globe and the Oscar for their work. The company's specialists discovered that their film was downloaded illegally many times through BitTorrent, compiled a list of 4726 unique IP addresses and contacted the iiNet provider, who owned the addresses, with the requirement to transfer personal data to users. However, the provider did not agree with this and filed a request with the Australian Federal Court, which ruled that Dallas Buyers Club LLC should pay for the disclosure of private information.
Moreover, the court by its decision limited the amount of the fine, which the company will be able to recover from the caught user, if she pays according to the verdict and gets access to the data she needs. Interestingly, earlier in April of this year, the court nevertheless agreed that Dallas Buyers Club LLC could get the information it needed (still free), but a little later the court’s decision was suspended and the judges demanded to provide them with a copy of the letter, which they would receive "Pirates". It turned out that in addition to collecting the actual fee for a licensed copy of the film and some fine for its pirated distribution, the company intends to arrange for the “additional losses” at the expense of users, and also to compensate for the loss of just those 600,000 Australian dollars that must be paid.
