Telegram: block cannot be canceled

The epopee with the blocking of the Telegram messenger in Russia is still ongoing. As far as we know, in some way Roskomnadzor backed down in the process of blocking everyone and everything - many subnets of Google, Amazon, Alibaba are already available within the country, although several days ago they were on the Roskomnadzor’s “black list”.

Nevertheless, an active standoff takes place now. In the process of struggle, oddities happen. For example, today on the official portal of courts of general jurisdiction in Moscow it was reported that the decision to block Telegram has not yet entered into force, and the corresponding note has been removed from the website of the Tagansky Court (although it was in place on the morning of May 15).

But why, then, the decision of the Tagansky court to block the Telegram at the suit of Roskomnadzor is considered fulfilled? After this strange situation became known, representatives of the court were quick to explain, Interfax reports.

"Satisfying the applicant's request to appeal for the immediate execution of a court decision, the court proceeds from the assumption that a prolonged non-execution of a court decision may lead to significant violations of the constitutional rights of personal data subjects, to cause significant damage to public and private interests," the judge Yulia said in the full text Smolina

It turns out that the decision is subject to immediate execution for the simple reason that the court protects the rights of the messenger users (according to the court, of course). In general, the blocking decision itself consists of two parts. The first part declares the necessity of blocking Telegram as a whole, the second one speaks about the immediate execution of the decision (even before its entry into force). That's just the second part of the court decision and allowed to start blocking the messenger almost immediately after the completion of the court hearing of the case on the suit of Roskomnadzor.

On April 18, Telegram lawyers filed a complaint against the decision to immediately block until it received further development. Then an appeal against the decision was filed, which was not even considered on its merits.

It remains only to wait and watch the development of events. Pavel Chikov, the head of the law firm that protects Telegram's interests, advises the following : “Keep calm. Telegram works, lawyers too. ”
