The Ministry of Communications and Mass Media of the Russian Federation has prepared a preliminary text of amendments to the Law “On Communications”, according to which the key elements of the infrastructure of the Russian segment of the Internet should belong to the state. Unfortunately, the text of the amendments is not yet available on the portal regulation.gov.ru (it is likely to appear there in the coming days), but on Thursday it was discussed at a meeting with the Deputy Minister of Communications, which became known to journalists of the newspaper Vedomosti.

The amendments suggest that the law "On Communications" will introduce the concept of "critical infrastructure", which should be under state control. Critical infrastructure offers include:

Accordingly, three key changes are proposed that establish the controlling role of the state.

1. Domain management .RU and . only state-owned company. That is, only a Russian legal entity established by the Ministry of Communications itself can be the administrator of these domain zones. At the moment, this role is performed by the Coordination Center of the Internet National Domain (CC), which should be nationalized . The administrator will be financed due to the annual deductions of telecommunications companies to the universal service reserve (they now transfer 1.2% of their income there).

2. Only Russian legal entities will be owners of traffic exchange points in the Russian Federation. Each traffic exchange point will need to get a license. Recall, at the moment, the MSK-IX traffic exchange point is at the 5th place in the world in terms of traffic bandwidth (2135 Gbit / s), and is legally registered as a joint-stock company MSK-IX. According to knowledgeable persons, the controlling stake is owned by Safedata, acquired by Rostelecom.

But one of the largest backbone operators RETN is controlled by the British company RETN through the Russian representative office of RetnNet JSC. CDN (Content Delivery Network) operators also fall under the law on the nationalization of the Runet, sources from the Vedomosti newspaper say.

The Ministry of Communications is currently discussing whether to allow foreigners as co-owners and allow them to have up to 20% of the company's shares. The same requirements in the Russian Federation are now established in the law on mass media.

3. Creating a state system that should store information about autonomous systems, IP-addresses and traffic exchange points. Such a system will allow the Internet to function in the event of a complete disconnection of external communication channels and isolation from the rest of the Internet.

According to the Ministry of Communications and Mass Media, state control will ensure “integrity, continuity, stability, stability and security of the functioning of the Russian national segment” of the Internet.
