According to the new recommendations proposed by MarkMonitor and other organizations that represent the same forces that supported SOPA, domain owners associated with “commercial activity” will no longer be able to protect their private data using WHOIS hiding services. “Commercial activity” is an extremely broad concept, which means that a huge number of domain owners will be affected. The service that provides you with a private WHOIS service (“privacy provider”) may be forced to publish your WHOIS contact information or transfer it to any person complaining about your site, bypassing proper legal procedures. Why should a small business owner publish his home address just to start a website?
