Hacker got off with a fine of $ 10 thousand instead of 440 years in prison

A hacker in the Southern District of Texas, a suspect in connection with Anonymous , pleaded guilty to computer fraud and paid a fine of $ 10,000. This news would be too boring if it were not for one fact: a few months ago, 28-year-old Fidel Salinas was accused of 44 cybercrime, for each of which he could get 10 years in prison, that is, to sit down for 440 years.

The charges have already been dropped. According to defense attorney Thor Ekland (Tor Ekeland), they were based on the erroneous interpretation of US computer crime laws to intimidate his client and force him to agree to a deal. The lawyer noted the aggressiveness of the prosecutors and their desire to put pressure on the defendant as much as possible by any available means, including the media.

Of the 44 "crimes", 18 were committed on one site: each time Salinas left spam texts on the victim's site, pressing "send" was counted as a separate episode of cybercrime. The other 15 “crimes” - according to the lawyer, are Salinas site views using commercially available vulnerability scanning tools, such as Acunetix and Webcruiser.

The uncertainty of the laws allowed in the first case to use the “substantial emotional stress” of the victim, that is, the owner of the site, as the basis for the accusation.

Despite the fact that all the charges were dropped, the lawyer noted that Fidel Salinas was already “pinned to the pillory by the press,” and that his client’s reputation was finally spoiled by the efforts of prosecutors.
