Roskomnadzor retroactively replaced its document on the federal portal


Roskomnadzor grossly violated the rules for discussing draft regulations on the federal portal regulation.gov.ru, writes Cnews. On February 5, 2018, Roskomnadzor received a negative opinion on the results of the SALT procedure, that is, the regulatory impact assessment (see the screenshot above). Bypassing the established procedure Roskomnadzor retroactively replaced the document on the portal. The original version disappeared without a trace, and the corrected version immediately with the positive conclusion of the OCB went to the Ministry of Justice for approval.

We are talking about the draft order of Roskomnadzor on methods of blocking providers access to banned Internet sites.

The original version of the document drew criticism from the Ministry of Economic Development and other interested parties. Criticism caused the following rules of the project:


In the new version, the above norms have been removed, so the amended document immediately received a positive assessment from the Ministry of Economic Development (probably, the document was replaced with the consent of the Ministry of Economic Development).

Positive conclusion of the WWS on the draft Roskomnadzor

“According to the regulations, in the event of disagreement, they should have been resolved by the government,” Philippe Kulin, the general director of the dense forest hosting provider, said in a comment to Cnews, who participated in the public discussion of the document. “We are dealing with the substitution of both the original document from Roskomnadzor and the conclusions on it.”

The expert noted that the edits made in the draft are welcome. But this does not cancel the fact of violation of the procedure by Roskomnadzor. Some may say that in Russia government departments do not comply with the letter of the law and produce the retroactive continuity described in the novel “1984”.
