The draft law on regulating the work of instant messengers and streaming services in the Russian Federation will be ready in April

Roskomnadzor and Media-Communication Union are preparing a corresponding document, referring to the experience of other countries

The head of Roskomnadzor, Alexander Zharov, announced the imminent completion of work on the preparation of a draft law on regulating the activities of streaming services and instant messengers in Russia. The document will be published by the end of April, writes "Kommersant". Zharov himself made a statement at the Truth and Justice Media Forum in St. Petersburg.

“With regard to streaming services like Netflix and instant messengers, now regulatory approaches are being developed all over the world. Now experts of the Media-Communication Union (ISS) are developing a bill that will regulate both content resources and messengers, ”the head of the department said.

“It is obvious that domestic services should be in equal or priority conditions to transnational giants such as Netflix. This issue should be resolved, ”added Alexander Zharov.

As already reported on Geektimes, domestic officials are planning to oblige Netflix to obtain a license from the media and the broadcaster. In addition, domestic merchants are also dissatisfied with the launch of the service in Russia. Russian business has already proposed to legally restrict Netflix in the Russian Federation. Also, Russian officials are interested in how Netflix will comply with the law on the localization of personal data of Russians.

As for domestic business, earlier Sergei Petrov, head of the Media and Communications Union (ISS), said at an expanded meeting of the Tatarstan Press and Mass Communications Agency board that Russian companies could advocate for restrictions for the video streaming market in Russia. The president of the ISS said that Netflix could threaten the prospects for import substitution. For example, Netflix buys the rights to show TV shows from Western partners, without ordering anything from local companies.

The draft law regulating the work of instant messengers began to be developed in December last year. The authors of this bill propose to amend the laws "On Information ..." and "On Communication." The draft law introduces a new concept of “information and communication services” - “text, voice, and picture messaging services that are technologically inextricably linked to communication services provided by third parties on data transmission networks of telecom operators”.

In the document itself (its draft dated last December), the messengers are called “organizers of information dissemination”, who “must ensure the reception and transmission of messages in the networks of operators”. In this case, the exchange of messages, according to the authors of the document, should take place only between the identified users. Thus, the instant messenger must independently identify users, as well as limit unwanted mailings of mass messages and information, which is distributed in violation of the law. Such information may be spam, and, for example, unwanted political advertising during elections.

The problem, according to some officials, may be full data encryption in instant messengers. The same Telegram (and now WhatsApp ) introduced end-to-end encryption of all messages, photos, video files and voice calls. German Klimenko, an adviser to the president of the Russian Federation on the Internet, believes that Telegram will either agree with the authorities or simply close it.
