"Roskomsvoboda" filed an appeal against the decision of the court to block torrent trackers

The public organization "Roskomsvoboda" (a project of the Pirate Party) and the "Center for the Protection of Digital Rights" filed an appeal against the decision of the Moscow City Court , which sentenced eleven websites to "perpetual" blocking in Russia. The reason for the appeal is that the representatives of none of the listed sites were not notified of the court session at which the decision to block was made. This is a gross violation of the procedural rules, the legislation of the Russian Federation - and an obvious reason for the cancellation of the court decision.

Human rights activists are going to appeal the rule about eternal blocking in the Constitutional Court. Presumably, this and other innovations of the Federal Law on Information (364-) violate the Constitution of the Russian Federation.

In addition, a collective administrative lawsuit is being prepared against Roskomnadzor, which is accused of significantly exceeding its authority.

“We received a lot of calls from site owners, for whom on October 14 this year, a decision was made to permanently block,” said Darbinyan. “None of them received any claims about copyright infringement and the removal of unlicensed content. In addition, none of the administrators of these sites, nor their hosting providers, have received notifications from the Moscow City Court about the commencement of the consideration of the claim about permanent blocking. They learned about the decision only from media reports. This is an obvious violation of their procedural rights, the rights of millions of Russian Internet users and the principle of adversarial nature. In addition, such actions discredit the entire order of work between the parties, detailed in Art.15.3 and Art. 15.7 Law “On Information” and bring chaos for further enforcement ”.

“Since the adoption of the second package of anti-piracy legislation and the start of enforcement, we have been able to make sure that the majors are not interested in deleting unlicensed content downloaded by the users themselves,” the lawyer added, “Antipiracy law is increasingly used for copyright trolling (extortion of money amounts under the threat of blocking websites) and is applied in practice with a multitude of violations even of the algorithm of the interaction of rights holders with website operators prescribed by law ”.

On October 14, the Moscow City Court decided to block access to 11 Internet resources: bobfilm.net, dream-film.net, kinokubik.com, kinozal.tv, kinokubik.com, kinozal.tv, kinokubik.com, kinozal.tv, kinozal.tv, kinozal.tv, kinozal.tv, kinozal.tv. .ru, rutor.org, seedoff.net, torrentor.net, tushkan.net, tv.serial-online.net, wood-film.ru.

Soon, the list of “forever blocked” was added to Pleer.com and RuTracker.org.
