iPhone: trademark ambiguities

The release of Apple's new device, which combines a mobile phone and an iPod, was accompanied by numerous questions about how the company is doing with the right to the iPhone trademark.

After all, the IT giant Cisco, who owns the name of the iPhone, three weeks ago released its Internet phone under this name through its Linksys office. Some commentators said that Apple could change the name of the new product to PodPhone to avoid a conflict with Cisco.

Charlie Giancarlo, general director of product development at Cisco, Charlie Giancarlo told The Times at CES in Las Vegas that Apple’s offers to buy rights to use the iPhone trademark were declined several times.

Mr. Giancarlo says: “The iPhone brand has been owned by us since 1996. Apple offered to sell that name to them. We did not want to give it up. ”

A few days ago, Cisco representatives confirmed that Apple has repeatedly sought permission to use the iPhone trademark for several years. There is information that the final terms were offered to Apple already the night before Jobs’s performance on MacWorld, however, the conditions of the contract are still kept secret by Cisco.

A Cisco statement on January 9 states that Cisco perceives the iPhone presentation as acceptance of the conditions proposed on the eve of the presentation of their new product. However, Phil Schiller, vice president of marketing for Apple, did not comment on whether Apple agreed (and in general whether it intends to do this) to the terms of use of the iPhone trademark that Cisco offered.

“There are several companies that used the iPhone brand, but this is the first time that the product is a mobile phone,” Schiller told AFX news agency. “We think that this name is perfect for a mobile phone,” he added. An Apple representative in London was not available to comment on this case.

Separate conversation is to rename the device to display the video on the computer on the TV screen. The device was developed under the code name iTV. The final release will be called AppleTV.
