The Big Three will pay for too high tariffs if the Federal Anti-Monopoly Service proves its guilt. FAS opened a case against
MTS ,
Megafon and
VimpelCom (Beeline brand) in connection with the violation of the Law on Protection of Competition.
Operators have introduced po-client SMS traffic accounting for SMS aggregators. This innovation has led to an increase in mailing rates. FAS interprets this behavior of operators as a violation of Part 1 of Article 10 of the Law on Protection of Competition.
The case was initiated by the appeal of the companies
National Processing Center LLC and
SOGAZ-MED Insurance Company OJSC , which used the services of sending through SMS aggregators.

Earlier, there was a system for calculating the services rendered for the total volume of SMS traffic between the SMS aggregator and the telecom operator. The traffic coming from all customers of mailings to subscribers of a telecom operator through SMS aggregator equipment was taken into account. The FAS Russia has established that as a result of the introduction of a poker client accounting system, the SMS aggregator pays the telecom operator a monthly amount of SMS traffic from each final distribution customer, the service says. This change in billing procedures resulted in higher tariffs for end customers.
However, the Big Three mobile operators disagree with the FAS accusations.
“MTS did not raise prices for sms-mailing packages. The transition to customer account sms-traffic is another step in the fight against spam, ”
explained the representative of MTS Dmitry Solodovnikov.
According to him, after the entry into force of the amendments to the Law "On Communications", aimed at combating illegal mailings, at the end of 2014, the company developed new contract terms. They allow the operator in all mailings to see the final customer mailings in order to quickly identify unscrupulous dispatchers, block spam at the first request of subscribers and, if necessary, apply penalties to violators who send messages without the consent of subscribers.
Megafon considers its actions lawful and is ready to provide all the materials if it receives such a request from FAS, ”said company spokeswoman Yulia Dorokhina.
“VimpelCom did not increase the tariffs for mailing to its network,” says VimpelCom’s press secretary, Anna Aybasheva.
The case of the “Big Three” will be considered on February 25, 2016.
