Penalties for failure to comply with the law on the "right to oblivion" for search services will become a reality

A relatively new bill that introduces fines of up to 3 million rubles for Internet search engines, for failure to comply with the law on the “right to oblivion”, received the support of the special committee of the State Duma on information policy. Alexei Kazakov, one of the authors of this bill, has now introduced a new proposal - to consider the possibility of blocking search engines for repeated violation of court orders to delete information, Kommersant writes . And the head of the committee mentioned above, Leonid Levin, gave a recommendation to the State Duma to adopt this bill in the first reading already.

“The Committee conceptually supports the adoption of this draft law, however, it draws attention to the fact that failure to execute a court decision should be the basis for attracting search system operators,” said Leonid Levin. The law itself on the “right to oblivion” was signed by Russian President Vladimir Putin on July 14. This law obliges search services to remove from issuing links to sites that “allow access to information about an applicant distributed in violation of the legislation of the Russian Federation, which is inaccurate, as well as irrelevant, no longer relevant to an individual due to subsequent events or his actions” citizens. At the same time there are exceptions - if we are talking about events that contain signs of criminal acts.

The new bill provides for the possibility of introducing fairly large fines for those search engines that do not comply with the law on the “right to oblivion”. “Failure by a search engine operator to comply with the requirements of a citizen ... to stop issuing links allowing access to information about this citizen” will result in the imposition of an administrative fine in the amount of 100,000 rubles on the search service. If, within five days, the search service fails to comply with the court’s decision on the citizen’s claim to stop issuing links, the amount of the fine may be increased to 3 million rubles.

In this case, the bill may appear significant changes by the second reading. For example, it is now proposed to consider the question of the possibility of bringing to responsibility for repeated non-execution of court decisions. Also the date of entry into force of the bill will be specified.
