Samsung considers Euroset’s claims for damages due to defective devices unsubstantiated
Samsung has provided arguments in response to Euroset’s claims regarding the supply of defective devices. According to representatives of Samsung Electronics Rus Company, Euroset backed up its claims with claims received from buyers. But some of them have long ended in settlement agreements. Moreover, the statute of limitations for such claims has already expired, since they date back to 2012.
Samsung also claims that a significant number of acts submitted by Euroset were paid repairs at the Pro-Service center. And if the service center received money for such repairs, then it hardly has anything to do with “the facts of alleged damage” of the organization. Therefore, the South Korean company is not going to pay compensation in the amount of 150 million rubles, which the retailer requested in a lawsuit.
Finally, Samsung insists that the overwhelming majority of acts do not state that the goods transferred for repair were purchased in Euroset. It also does not allow to establish a causal link between the repair of goods and the losses allegedly incurred by Euroset.
