The law on the storage of personal data will come into force in September, this year will check 317 companies

The head of Roskomnadzor, Alexander Zharov, said that the law on the storage of personal data in Russia (F3-242) will enter into force on September 1, 2015, as planned. Business representatives proposed to postpone the entry into force of sanctions for non-compliance with the law, but this proposal did not find support from officials, Kommersant writes . Zharov said that “it’s time to put an end to discussions on postponement. There will be no collapse in the industry. ” By the end of the year, Roskomnadzor plans to verify the implementation of the law on the example of 317 companies, which is about 0.012% of all organizations working with personal data in Russia.

The first to be tested are companies such as General Motors, Scartel, LUKOIL-Inform, and the St. Petersburg branch of Rostelecom. In addition, representatives of the social network Facebook are planning to visit Roskomnadzor on August 25 in order to consult on compliance with the Federal Law-242. Neither Facebook nor Google is planning to check this year.

Nevertheless, the Roskomnadzor, on behalf of the Prosecutor General’s Office, may begin to verify the companies, in the event that they receive the corresponding appeals from citizens who believe that the services process user data in violation of the law. According to Zharov, the check will proceed as follows: “The inspector (Roskomnadzor - editor's note) comes to the company that works with personal data, and says:“ Please provide documents that confirm that the server capacities that store these data located in the territory of the Russian Federation. " The company replies: "Please." And in 99.9% of cases, this test ends. ” If a violation is discovered, Roskomnadzor is obliged to transfer the case to the court to determine the amount of damage caused to Russian citizens. The punishment for violating companies is provided in two types: fine and blocking of the site.

As for the Twitter microblogging service, this company will not have to transfer data to the Russian Federation at all, since the data on users who store the service are not considered personal data, Vedomosti reports .

At the same time, the law permits the processing of personal data abroad in cases where the activities of companies are governed by international agreements - Alexander Zharov announced this yesterday. Thus, visa centers, air carriers and the media were thus withdrawn from the operation of the law.

Recall that the law prohibiting the storage of personal data of Russian users on servers outside Russia was adopted last summer.
