The Ministry of Communications and the Public Chamber proposes new measures to protect users of mobile networks

Project participants of the Public Chamber "Perspective" propose to include instant messengers in the list of data distribution sources in mobile networks. In addition, they want to hold mobile spammers accountable and make the appropriate amendment to the Law on Advertising. And the Ministry of Communications and Mass Communications is tightening the requirements for operator equipment.

For SMS-mailing, performed without the consent of users, advertisers are at least some responsibility. But if we are talking about spam in instant messengers such as Viber , WhatsApp and Telegram , the law does not provide for any liability. Although messages also come on mobile devices.

“The problem is that the Federal Antimonopoly Service does not recognize Viber, WhatsApp and other popular messengers as information transmission links in the telecommunication system, since this is not spelled out in the law“ On Advertising ”. Article 18 of the Law “On Advertising” states: the distribution of advertising over telecommunication networks (telephone, facsimile, mobile radiotelephone) is permissible only with the prior consent of the subscriber or addressee. The absence or presence of consent still needs to be proved. But, be that as it may, the Federal Antimonopoly Service of the Russian Federation has no authority to search for spammers.

To expand the powers of law enforcement, the Ministry of Communications has launched a new initiative to replace information gathering technology in networks. It will enable law enforcement agencies to track not only voice and Internet traffic, but also communication via instant messengers such as Skype, Viber, WhatsApp. Operators must now install new equipment that will allow them to collect more information about users.

The old technology of 2011 did not allow this. Therefore, the agency puts forward new requirements for equipment for communication networks. Technology IMS (IP Multimedia Subsystem) combines voice, text, graphics and video. This data is then transmitted over the network.

IMS works with packet data networks (LTE) and with mobile radio telephone networks (GSM and UMTS). In LTE networks, a user cannot be identified by a phone number.
