Google denies “Yandex” accusations of violating Russian law

In February of this year, Yandex filed a complaint with FAS against Google, accusing the corporation of violating Russian competition laws. Yandex believes that Google is forcing partners producing mobile devices to refuse to install applications competing with similar Google software. Soon after filing a complaint, FAS filed a case.

Today, Google’s first public reaction to the lawsuit “Yandex”. Google lawyer for corporate disputes Tero Luko believes that the company does not violate Russian laws. The fact is that Google has concluded partnership agreements with manufacturers of smartphones, RBC quotes it. The essence of the contract - the distribution of profits when installing Google services on the Android platform. True, Luco did not disclose the terms of such agreements, but said which agreements are usually concluded with the partners of the corporation.

The first type of agreement is the Mobile Application Distribution Agreement (MADA). The second type is called the “Profit Sharing Agreement.” This agreement specifies the conditions according to which the company receives its share of the search profits. In the second case, the manufacturer Should install services and applications from Google, and not analogues from competitors.

If Google’s competitor’s services are preinstalled, the contract will be terminated.

According to Luco, all individual contracts are concluded separately with each of the manufacturers. According to a Google representative, competitors may offer smartphone manufacturers more favorable terms by entering into their own profit sharing contracts.

“We are sure that we are not violating Russian competition laws. Yandex is the most popular search engine in Russia, and it can offer its own terms, ”Luco commented on the situation.
