EFF proposes patent reform

The Electronic Frontier Foundation launched the Defend Innovation website, which outlines a patent reform plan. “The patent system is in crisis and threatens the future of software development in the United States. We need to create a system that protects innovations, not hinders them, ”the EFF said in a statement.

Seven EFF Proposals for Patent Reform:

1 . Shorten the term for software patents: they should be valid for no more than five years.

2 If the patent is invalid and the court has not revealed any violations, the troll must pay legal costs.

3 A patent applicant must provide an example of a workable program code for each item to which he claims rights.

4 Violators should be exempted from liability if they independently carried out their development.

5 Patents and licenses should be immediately publicly available. Patent owners are required to timely update open records.

6 The law should limit the maximum damage, so the patent owner should not receive millions of dollars if the patent covers the entire tiny portion of the defendant's product.

7 Congress must initiate a study and schedule a hearing in order to check if there is any benefit to the economy from software patents.

Internet users are urged to leave signatures for patent reform on the Defend Innovation website, and experts and company representatives will express their opinion on the patent system and on the reform proposed by EFF.

Some experts have already expressed in the sense that the EFF is making a serious mistake by proposing a reform of the patent system instead of completely abolishing software patents. For a radical solution to the problem are the Free Software Foundation, Red Hat and other organizations.
