Two years in prison for mentioning drug names on the Internet - the bill was passed yesterday in first reading



On the evening of March 25, one remarkable draft law from Spring was adopted unanimously in the first reading, which I want to tell about in more detail. In addition, the authors praise that its adoption in 2 and 3 reading is also agreed with everyone.

Criminal liability is introduced - 2 years in prison - for the "promotion" of drugs on the Internet.
2) supplement the Criminal Code of the Russian Federation with article 228.5. as follows:

228.5. Promotion or advertising of narcotic drugs, psychotropic substances or their precursors, plants containing narcotic drugs or psychotropic substances or their precursors, and their parts containing narcotic drugs or psychotropic substances or their precursors, using information and telecommunications networks (including the Internet) )
Propaganda or advertising of narcotic drugs , psychotropic substances or their precursors, plants containing narcotic drugs or psychotropic substances or their precursors, and their parts containing narcotic drugs or psychotropic substances or their precursors using information and telecommunication networks (including the Internet ") - shall be punished with a fine of up to fifty thousand rubles, or in the amount of the salary or other income of the convicted person for a period of up to six months, or mandatory bots for a period of one hundred and eighty to two hundred and forty hours, either by correctional labor for up to two years, or by restraint of liberty for a term of up to two years, or by imprisonment for the same period .

The bill explicitly states that a mere mention of the name of a drug will be considered this very “propaganda” with all the ensuing consequences:
propaganda of narcotic drugs, psychotropic substances or their precursors, narcotic plants, or their parts containing narcotic drugs or psychotropic substances or their precursors - distribution of images and (or) names (including in foreign languages) narcotic drugs, psychotropic substances or their precursors , narcotic plants or their parts containing narcotic drugs or psychotropic substances or their precursors , information about the methods and methods of their development, production, cultivation and use, description of any advantages in the use of certain narcotic drugs, psychotropic substances, their analogues or precursors, narcotic plants or their parts containing narcotic drugs or psychotropic substances or their precursors, the dissemination of information on the use of narcotic drugs for medical purposes drugs, psychotropic substances, narcotic plants or parts thereof, containing narcotic drugs or psychotropic substances or their precursors that suppress Olu person or negatively affect their mental or physical health, as well as the production and distribution of books or audiovisual products, media products containing such information, or perform other actions to disseminate the information.

In sum, mentioning the name of a drug or precursor on the Internet (and precursors — for example, sulfuric acid or benzaldehyde) for any purpose — will be grounds for criminal liability.

There are serious questions to the competence of the writers - no exception has been made even for official purposes, such as a list of precursors. Not to mention school textbooks chemistry.

About the idea itself - to punish in prison for publishing any information - I generally keep quiet. It remains only to lay out the methods of suicide to condemn.

Characteristically, the Legal Department in the responses to this draft law did not have questions about such a broad definition of “propaganda”.
Even more than that, they offer to extend the zone of the bill not only on the Internet, but also on offline.
