Ericsson demands to ban sales of Apple devices in the US

Ericsson insists on banning sales of Apple mobile devices in the United States. The reason was the refusal of Apple to pay license fees to Ericsson for technologies that are used in Apple. The company Ericsson intends to achieve this through the courts.

Ericsson sued seven new lawsuits against Apple, accusing 41 mobile technology patents of violating 2G and 4G wireless communications, displaying information, energy-saving technologies, and mobile operating system principles.

In mid-January 2015, the license agreement between Apple and Ericsson expired. Negotiations on its extension began 2 years ago, but so far the companies have not come to a solution that would suit both parties. And now Apple simply refused to pay license fees. “We offered them to license these technologies. They refused, ”said Kasim Alfalahi, head of intellectual property at Ericsson. The company asks to take into account that $ 5 billion is spent on research and development of technologies every year. In this regard, it is expected that this work will be assessed as expected.

In addition to the court, the company Ericsson appealed to the ITC (Commission on International Trade of the United States), which will investigate the situation faster than the judicial authorities. Moreover, ITC has all the powers to impose a ban on the import of Apple products in the United States. Ericsson also used the services of an independent arbiter, who determined the appropriate amount of licensing fees for Apple.

However, Apple believes that Ericsson does not have the right to demand interest on each device sold. “It turns out that, by endowing products with our own technologies and thereby increasing their value to consumers, we have to pay more royalties for this than others. This is wrong, ”Apple says.

Ericsson is being reprimanded for bribing the courts and lobbying its position in the field of patent law. In fairness it should be noted that in the past few years, Ericsson has really been very actively protecting its intellectual property. In 2012, the company filed a lawsuit against Samsung Electronics in connection with disputes over license fees. As a result, a compromise was found. Thus, in the fourth quarter of 2013, Samsung’s contribution to Ericsson’s net profit amounted to $ 409 million.
And in December last year, the company Ericsson achieved through court a ban on the sale of Xiaomi products in India.
