USPTO approves Facebook trademark for Facebook

Yesterday, the US Patent Office approved a Facebook application for the Face ™ trademark for use in “telecommunications services, namely, online chat rooms and electronic bulletin boards for transferring messages between computer users in the field of common interests and on social and entertainment subjects for discussion, but not on functions or relating to the automobile business or automobiles. "



In other words, in communication services, now no company other than Facebook will have the right to use the word “face” in its name. This may seem strange, because “face”, in general, is a common word.



On the other hand, Facebook has gained such fame and popularity that now any name like Face ... something causes associations with Facebook, that is, trademark registration is probably justified.



In fact, the registration of common words as trademarks is a common practice. For example, Windows ™ is a registered trademark in the field of software (although they seem to have not tried to stake out the verb of win ™) or Dove ™ (dove) is a registered trademark in the field of cosmetics.

Also interesting is the fact that the first application for the Face ™ trademark was filed back in December 2005 by some British social network FaceParty, but Facebook lawyers knowingly eat their own bread, they dug up this case and were able to re-register Face ™.



Facebook has only to pay the due duty for three months from today, and also to state the Statement of Use and use Face ™ for the first time in its advertising - after which they will receive all rights to the trademark.



One can only hope that Facebook will not register a trademark with the word “book” and the current conflict with the Lamebook service is just a coincidence.
