A criminal case was opened against the “world's biggest spammer”

The Investigation Department at the Internal Affairs Directorate in the Central Administrative District of Moscow opened a criminal case against the general director of Despmedia LLC Igor Gusev, who is considered the largest spammer in the world. Through the affiliate program Glavmed.com "Despmediya" engaged in the sale of counterfeit pharmaceutical products, including Viagra, in the United States, Canada and other countries of the world using spam. According to the investigation, the turnover of Glavmed.com over the past 3.5 years could reach $ 120 million.

Many details in the article of the newspaper "Kommersant".
I can not stand spam, but as a lawyer, I can not go against the "sewing cases": here are some quotes from the article:
A criminal case was initiated against Igor Gusev under Part 2 of Art. 171 of the Criminal Code (illegal business, coupled with the extraction of income on a large scale; up to five years in prison).
It follows from the case file that the Director General of Despmediya LLC Igor Gusev “entered into a criminal conspiracy with unidentified persons in order to carry out business activities without registering through the use of the Glavmed.com affiliate program”.
These actions were aimed at infecting computer users with viruses (to create a botnet for sending spam) and receiving money in Igor Gusev's e-wallet in the Webmoney system. Money in his address was transferred from an electronic wallet to Webmoney, owned by a foreign company Hzmedia Limited
and last:
Thus, “Igor Gusev accomplished business activities without registering as an individual entrepreneur and received an income of $ 1.956 million”
In my opinion - this is complete nonsense. And so you can bring a case against any Internet entrepreneur, it does not matter whether he sends spam or owns, for example, just a visited portal and sells advertising on it.
And here customers drew - the day before the article was published in Kommersant, the New York Times had already covered this event.
Add for the heap that the visit of the Terminator to Moscow also coincided in time with all the events described.
Once again, I am against spam in all its forms. But I am also against the Cop raids, carried out in favor of political or conjuncture moments. Under the illegal business can bring anyone who earned three pennies on the Internet, and not on the Internet, too.
Is spam not good? Make the appropriate law and try to spread spam. Moreover, as I understand it (although I may be mistaken), the business of GlavMed is not spamming, but the sale of Indian Viagra in the states by mail (cheaper than in pharmacies and without a prescription). And spam affiliates who have no relation to Glavmed. And they may not spam, but for example, engage in SEO or just place an advertisement.
