Google is judged for failure to provide data about the user

Bank of Rocky Mountain from Wyoming (USA) sued Google, demanding to give out personal data about one Gmail user. The fact is that the bank mistakenly sent confidential data about its customers to this user's address. 1325 businesses and individuals were compromised, and the sent files contained their names, addresses, UNN and social security numbers, as well as a full credit file for each of them.

As written statement of claim ( PDF ), the incident occurred in August 2009, and one of the bank employees is to blame. Responding to a letter from one of the bank's clients, he attached absolutely secret documents to the letter, and then sent them to the wrong address. The worker immediately found an error and “tried to withdraw the letter”, but without success.

Bank employees promptly contacted Google and told about their problem with a request to ensure the confidentiality of the data (that is, delete the sent letter), but the owners of the postal service refused. Then the bank employees sent another letter to the same address asking the unknown recipient to delete the previous message without opening it, as well as to call the bank, but they never received a reply. Then they asked Google to provide the person’s name and phone number to contact him directly, but Google responded that disclosing this information is contrary to the rules for using the Gmail mail service. Bank Rocky Mountain decided to sue. He also asked the judge to leave the case closed so as not to cause panic among the bank’s clients, but the court did not grant this request, so all the documents on the case have already been made public.
