RIAA will try again

Over the past year, the RIAA (Recording Industry Association of America) has sought a positive court decision on the lawsuit, which implies that providing access to files by placing them in shared network folders is a direct violation of copyright law and, accordingly, to the court.

However, the verdict rendered by Federal District Judge Neil V. Wake states that placing copyright-protected content in a shared folder is not in itself a punishable act and in order to apply any RIAA sanctions to the defendant in hand.

According to the latest information, the RIAA withdrew the previous lawsuit, which was based on the illegality of the named data exchange method and filed a new lawsuit with slightly modified wording. However, instead of bringing new charges against the same respondent, the association chose to find a new “victim”. Thus, the RIAA obtained a new judge who could make a decision that suits them.
