Sharing server software across multiple organizations

Due to the fact that lately there have been many questions about the sharing of server software by several organizations, Microsoft has released the following clarification of licensing policy:
In the case of server sharing by several organizations, for licensing connections to the server of one organization by external users or devices from another organization (affiliate), affiliates can purchase client licenses to connect to the server each for themselves.


In the case of sharing a server by several organizations, to legalize connections to the server of one organization of external users or devices from another organization (non-affiliated), the server owner must acquire the necessary licenses for devices or users of another organization to himself and provide the ability to legally connect to the server. By “required licenses” is meant the External Connector (if there are many external users who will connect to the server) or the required number of CALs.


Client licenses are assigned to a specific user or device. You can reassign a client license to another user or device either permanently or temporarily:
a) a CAL “per device” license to another device, if the main device does not work,
b) a CAL “per user” license for the temporary worker if the primary user is absent.
Example: if at different times 20 users of another organization are accessing the server, you need to buy 20 CALs “per user” CALs (one for each user).

You should also pay attention to the fact that the above scheme of sharing a server by several organizations, in which external devices or users get access to the organization’s server with its consent, does not constitute leasing of the software product, that is, does not violate the license agreement clause product for rent, sublease, rental or temporary use.

An example of a lease or temporary use is to place an application on its site and let it be leased to another organization by a service provider; or providing the organization of server equipment to create or maintain a server infrastructure. For such scenarios, you must sign the Service Provider License Agreement (SPLA).
