The 9th Arbitration Court of Appeal of Moscow corrected an arithmetic error that it made when determining the amount of the compensation amount in
the Vedomosti lawsuit against
RBC Information Systems . After making the appropriate amendments, the amount of compensation for illegal use of materials "Vedomosti" amounted to 2 820 000 rubles,
according to the winning party.
Recall, the court acknowledged the fact of illegal use by the respondent of 100 articles from the archive of the plaintiff, but voiced the amount of payment, 1000 times smaller than that required by the newspaper. The decision of the plaintiff was surprised, but probably not much - even then it was clear that the court had a reservation, typo or arithmetic error.
Lawyer Vladislav Bykov, who represented the interests of Business News Media (the publisher of Vedomosti) in court, commented to
Expert Online in an interview then: “The judge said that for each case of copyright infringement by RBC, the minimum penalty provided by law. Since the amount of the fine can vary from 10 thousand to 5 million rubles, in the aggregate the amount of compensation should be 2 million 820 thousand rubles. That is, the required unprecedented amount is understated considerably, but not a thousand times, but a hundred. ”
