The Appeal Board of the Belarusian National Center for Intellectual Property (NCIS) invalidated the registration of the MTS company trademark with the image of a red egg.
The poets Ales Ryazanov and the artist Victor Markovtz accuse MTS of plagiarism of their creation called “Egg-squares”.
On May 8, the Appeal Board will announce the decision on the second application of the authors of “Egg Quadrats”, who in October 2007 appealed to the center with objections to the registration in Belarus of the second trademark with a white egg in a red square, BelaPAN reports. ')
“We consider this decision to be absolutely illegal and unreasonable,” said Dmitry Khodas, director of the Belarusian branch of MTS. He said that it would be possible to speak about the legality of the decision only after the appeals council presents evidence, on the basis of which the registration of the commodity is invalid.
“So far, neither the Appeals Board, nor any other official opinion from the NCIS has declared the grounds for registering the trademark as invalid,” the director of the Belarusian MTS office said.
The motivational part must be submitted within two months. After that, after six months, the decision of the Appeals Board will enter into force. "That is, in the best case, the decision of the Appeals Board will come into force no earlier than seven to eight months," said Dmitry Khodas, reports Telegraph.
