The State Duma adopted a law banning SMS spam

If you prohibit everything, then sooner or later you can adopt some useful law. Apparently, according to this principle, the State Duma finally got to the SMS-mailings. Today, in the third reading, the deputies adopted amendments to the Law on Communication , prohibiting sending SMS, to which the subscriber did not subscribe.



According to "Rossiyskaya Gazeta", now for the distribution will require an agreement with the telecom operator, as well as data on the source database of telephone numbers. According to the amendments, it will be possible to send messages only to those subscribers who have agreed to receive the newsletter:

Distribution over the mobile radio telephone communication network (hereinafter referred to as broadcasting) should be subject to obtaining the prior consent of the subscriber, expressed by performing actions uniquely identifying this subscriber and allowing him to reliably determine his will to receive the broadcast.

Proof of consent must be the customer distribution. If you failed to prove - sending out is recognized as a violation.

The subscriber also received the right to require the operator to stop sending from a particular sender.

The law determines the SMS distribution by three criteria: mass character, automatic character and use of numbers not provided for by the Russian system and numbering plan (for example, short numbers and letters).

The WG also cites interesting statistics on the SMS mailing market: in 2013, it grew 1.7 times in Russia - to $ 101 million, with 70 percent of mailings being banks' notifications to their customers. The rest of the traffic was formed by advertising messages of trade networks, online stores, road carriers, service enterprises, electronic payment systems - however, a significant part of advertising traffic was spam.

It is curious whether it will kill the business of companies engaged in SMS-mailing, or they will be able to find a loophole to circumvent the requirement to conclude a contract between the organizer of the mailing and the operator directly?
