Legality of music services

Since the end of 2007, music services using embed content have become increasingly popular in runet. Those. You cannot download the file, but exclusively listen to it through the flash-player embedded in the page.

Last.fm is not considered as it is not a Russian service, Moskva.fm is also because it is primarily a radio aggregator.

How do these services avoid copyright issues? It's very simple: the users upload the content themselves, while clearly indicating that they agree that the uploaded file does not infringe the copyrights and, therefore, takes responsibility for the uploaded materials.

However, for content owners, the situation is far from the most pleasant: having a fast channel (suitable from 256 kbit / s and above) we can listen through almost all popular tracks through the above services without any restrictions. Novelties also do not take long to wait: all new songs appear almost immediately on social networks. Thus, using popular music services, the need to store music on a computer almost disappears.

Therefore, I would like to discuss the following questions with the community:
  1. 1) How legal are these services from the point of view of Russian legislation? If not, what tricks use the above services (servers not in Russia? Owner - offshore company? Something else?)
  2. 2) How legal is the service, allowing you to group songs uploaded by users into playlists without any restrictions (like bee.fm, there are no more than 5 tracks per playlist)?
