The Ministry of Culture proposes to impose heavy fines for violating the procedure for blocking pirated content
Recently, a draft law from the Ministry of Culture appeared on the Web regarding the violation of the order of blocking pirated content. The authors of the project propose to impose very large fines (from 100 thousand to 1 million rubles) on the site owners and hosting providers, in case of the latter’s refusal to block pirated content.
The same draft law spells out fines for private and public officials. In this case, the amount of the fine is 10-300 thousand rubles and 50-600 thousand rubles, respectively.
A fragment of the law is also interesting, where the Ministry of Culture proposes to impose a similar fine on the applicant for violation of the law on the protection of intellectual property by this or that website, in the event that the applicant reports “knowingly false information about the existence of rights to the object”. ')
In addition to fines, the draft law also spelled out the procedure for submitting an application by the right holder for violation of their rights, as well as the procedure for blocking and appealing such an application. If the law passes, then the owner of the content site will also be obliged to post on the resource a form for receiving statements about copyright infringement.
After receipt of the application from the copyright holder, the site owner and / or hosting provider must limit access to the disputed content within two days.
