"Union" lost a lawsuit to "Vkontakte"

Today it became known that the four millionth (in rubles) claim of the Soyuz studio to the Vkontakte social network was rejected by the court. This case was considered by the arbitration court of St. Petersburg and the Leningrad region. The essence of the claim is standard - the copyright holder, the studio "Union", makes claims regarding the unlawful placement of copyrighted content on the social network. In other words, users laid out the music belonging to the "Union", against which the "Union" and acts. But it is clear. Much more interesting is the court decision.

And it says that the Vkontakte management, and therefore the company itself, is not responsible for the content posted by social users. The administration of the social network is not directly related to the offenses mentioned, therefore there is nothing to punish the company for. Among other things, the court order stated that the social network is not able to monitor all the content that is uploaded by users of the resource. In addition, a social network, without the corresponding appeal of the right holders, is not obliged to independently check the content for the legality of the placement of this content. Responsibility for content placement court shifted to the shoulders of users.

The lawsuit itself was filed by the Soyuz in June of this year, demanding compensation in the amount of 4,575 million rubles.
